NEW YORK — Cartier, a division of Richemont North America Inc., and Cartier International B.V. filed a lawsuit against Bidz.com, an online auctioneer, and other defendants for alleged trade dress and design infringements. According to court documents filed in federal court here, Cartier alleged a number of violations of infringement, including trade dress, copyright, trademark and design patent, of a number of its watch designs. The watch designs include the Tank Française, Pasha de Cartier Grille, Tank Divan and Panthere. Cartier alleged that Bidz.com and David Zinberg, an officer with the company, and Nisimov Watch Co. and Alan Nisimov, a managing agent with the company, distributed, advertised and sold “watches bearing copies” of one or more of the listed watch designs and trade dress. The jeweler asked for statutory and punitive damages as well as a permanent injunction against the named defendants for “willful infringement.” Bidz.com did not return a call for comment by press time.
Chanel Inc. filed a lawsuit to enforce its trademarks against Golden Stone Trading Inc., which does business as etradingcity.com, gsbag.com and lookielooks.com. According to court documents, Chanel alleged trademark counterfeiting and infringement, false designation of origin, federal trademark dilution, common law trademark infringement and common law unfair competition against the named defendants. Chanel asked the court for a preliminary and permanent injunction and for statutory and punitive damages. The case was filed early in March. Golden Stone could not be reached for comment.
Barbarian Rugby Wear Inc. filed a request for declaratory judgment against Polo Ralph Lauren USA Holdings, stating that its use of its trademark doesn’t infringe on PRL’s and seeking cancellation of registered marks held by the company. The trademarks in question are Rugby Rocks!, Barbarian Rugby Wear, World Rugby, Rugby North America and Rugby, according to the court documents. Barbarian Rugby Wear alleged that its registered marks predate PRL’s and asked the court to issue a declaratory judgment in its favor and for damages to be awarded. PRL did not return a call for comment.

Anthropologie and U.O.D. Inc. filed a copyright infringement lawsuit against Forever 21 last month in Manhattan federal court. According to the court documents, Anthropologie alleged that Forever 21 was selling skirts that feature “a pattern, fabric and color scheme that is identical or virtually identical to the pattern, fabric and color scheme” that is featured in its own copyrighted skirt. Neither retailer returned calls for comment. The counts in the lawsuit against Forever 21, filed March 30, included copyright infringement, federal and common law unfair competition, and deceptive trade practices. This is the second lawsuit Anthropologie and U.O.D. have filed in the last nine months alleging that another retailer infringed on patterns, fabrics and color schemes of skirt designs. At the end of September, Anthropologie filed a lawsuit against Wal-Mart, also in Manhattan federal court, for alleged copyright infringement, unfair competition and deceptive trade practices.
