NEW YORK — Chrome Hearts LLC and OSA International filed a lawsuit against Uniopt GmbH, which does business as Robert La Roche Eyewear, for allegedly infringing on an eyeglass frame copyright. OSA has the exclusive license agreement to produce eyewear under the Chrome Hearts trademark. Chrome Hearts alleged that Robert La Roche sold eyewear frames that infringed on its floral cross design at eyewear trade shows. The company asked the court for financial damages to be determined at trial. According to legal papers, Uniopt GmbH and Robert La Roche are based in Austria. They could not be reach for comment.
Shape CD Ltd. filed a patent infringement lawsuit against Quiksilver Inc. and other unnamed defendants in Manhattan federal court on March 9. Shape CD alleged that Quiksilver used hangtags on clothing that infringed on its design for a tag that digitally provides product information to the consumer. In addition to allegations of patent infringement, the complaint also accuses Quiksilver of inducement to infringe the patent, for allegedly persuading others to infringe on the registered patent. Shape CD asked the court for unspecified financial damages. Quiksilver did not return calls for comment.
Roseville Fountains, Peter P. Bollinger Investment Co. Folsom Central and Inter-Cal Real Estate Corp. filed a lawsuit against Westfield Corp. in the California Supreme Court on March 9. According to legal documents the complaint was filed for alleged breach of a confidentiality agreement, misappropriation of trade secrets, unfair competition, unjust enrichment, intentional interference with prospective economic advantage, intentional misrepresentation and breach of covenant of good faith. The plaintiffs alleged that Westfield disclosed confidential information related to The Fountains Shopping Center, which was to have been a joint business enterprise between the parties, in Roseville, Calif. According to court documents, the breach created issues for the plaintiffs in developing the property. The complaint asked for unspecified financial damages. Westfield declined to comment.
